Noctua is a mobile application that delivers personalized inspirational quotes powered by artificial intelligence. The application is published by Noctua, based in Paris, France.
By downloading, installing, or using the Noctua application, you agree to be bound by these Terms & Conditions (hereinafter "T&C"). If you do not agree to these terms, please do not use the application.
The Noctua application is available free of charge. Its business model is based on advertising. No subscription or in-app purchase is required to access the core features of the application.

We reserve the right to modify, suspend, or discontinue all or part of the application at any time, without prior notice or compensation. We shall not be held liable for any temporary or permanent unavailability of the application.
The application uses an anonymous authentication system. A unique identifier (UUID) is automatically assigned to each user upon first use. No traditional account creation (email/password) is required to access the basic features.
You may optionally complete your profile by providing personal information (first name, last name, email address, phone number, gender). This information is used to personalize your experience and is not required to use the application.
If you choose to provide personal information, you agree to provide accurate, complete, and up-to-date information. You are responsible for updating this information in the event of any changes.
The Noctua application is intended for strictly personal and non-commercial use. You may view, save, and share the quotes displayed within a private context.

In the event of a violation of these T&C, we reserve the right to suspend or terminate your access to the application, without prior notice or compensation, and to take any appropriate legal action.
The application displays advertisements provided by Google AdMob. These advertisements help fund the development and maintenance of the application while keeping it free for users.

Ad personalization depends on your consent. If you reside in the European Economic Area (EEA), the United Kingdom, or Switzerland, your consent is collected through the Google UMP platform before any personalized advertising is displayed. You can change your preferences at any time in the application settings (Personal Information > Manage Ad Preferences).
We are not responsible for the content of advertisements displayed by Google AdMob. Any interaction with an advertisement is at your own risk. We encourage you to review Google's Privacy Policy for more information.
All elements of the application (design, interface, source code, graphics, logos, icons, sounds, texts, layouts, databases, algorithms) are protected by French and international intellectual property laws. These elements are the exclusive property of Noctua or its licensors.
The quotes displayed in the application are sourced from the public domain or royalty-free sources. The selection, organization, and presentation of these quotes constitute an original work protected by copyright.
We grant you a personal, non-exclusive, non-transferable, revocable, and limited license to use the application on your personal devices, in accordance with these T&C.
Unless expressly authorized by us in writing, the following activities are prohibited:
Push notifications are entirely optional. When using the application, you will be asked whether you wish to receive notifications. You may accept or decline without any impact on your use of the application.

The application may contain links to third-party websites or services. We have no control over such content and shall not be held liable for their availability, accuracy, or any damage resulting from their use.

The application is provided "as is" and "as available." We make every effort to ensure the proper functioning of the application but do not guarantee that it will be free from errors, bugs, or interruptions.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Under no circumstances shall Noctua be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or business opportunities, arising from the use of or inability to use the application.
In all cases, Noctua's total liability under these T&C is limited to the sum of fifty euros (EUR 50).
The Noctua application is intended for individuals aged 18 years and older. By using the application, you confirm that you are at least 18 years old. If you are a minor, you must not use the application without the consent and supervision of a legal guardian.
Parents and legal guardians are responsible for monitoring the use of the application by minors under their care. If you become aware that a minor is using the application without authorization, please contact us at contact@noctua-app.com so that we can take appropriate action.
You may stop using the application and delete your account at any time. To delete your account and all associated data, go to Menu > Delete My Account. Deletion is permanent and results in the erasure of all your personal data within 30 days.
We reserve the right to suspend or terminate your access to the application at any time, without prior notice, in the event of a violation of these T&C or any behavior deemed detrimental to the proper functioning of the application or its other users.
Noctua shall not be held liable for any delay or failure in the performance of its obligations under these T&C when such delay or failure results from a force majeure event, including but not limited to: natural disasters, fire, flood, pandemic, war, strikes, internet or power outages, cyberattacks, government decisions, or any other circumstance beyond Noctua's reasonable control.
We reserve the right to amend these T&C at any time. Amendments will take effect upon their publication in the application or on our website.
In the event of a substantial amendment to the T&C, we will notify you through a notification in the application or by any other appropriate means.
Continued use of the application after the publication of the amended T&C constitutes acceptance of the new terms. If you do not accept the amendments, you must stop using the application and delete your account.
These T&C constitute the entire agreement between you and Noctua regarding the use of the application and supersede any prior agreement, written or oral, relating to the same subject matter.
If any provision of these T&C is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be interpreted to best reflect the original intent, and the remaining provisions shall remain in full force and effect.
The failure of Noctua to exercise or enforce any right or provision of these T&C shall not constitute a waiver of such right or provision.
You may not assign or transfer your rights or obligations under these T&C without our prior written consent. Noctua may freely assign or transfer its rights and obligations to a third party, including in the event of a merger, acquisition, or asset sale.
These T&C are governed by French law, without regard to principles of conflict of laws.
In the event of a dispute relating to the interpretation, performance, or termination of these T&C, the parties agree to seek an amicable resolution before initiating any legal proceedings. You may contact us at contact@noctua-app.com.
Failing an amicable resolution, any dispute shall be submitted to the exclusive jurisdiction of the courts of Paris, France, unless otherwise required by mandatory law.
In accordance with applicable consumer protection regulations, you have the right to use a consumer mediation service free of charge for the amicable resolution of any dispute. You may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
